This Privacy Policy outlines how the Canadian Professional Sales Association (“CPSA”, “we”, “us” or “our”) manages the personal information we receive about you. When you use any of our digital platforms, including www.cpsa.com (collectively, the “Website”), become a member, sign up or purchase our products, courses or services, or contact us about a question or concern, we may collect information, including personal information you provide to us (like your name, address and email address), information relevant to processing your transactions (like your credit card information), and information collected automatically via the Website (like cookies). We use such information to process your orders, to offer the services of the Website, and to enhance users’ experiences on the Website.
By accessing or using the Website, you consent to the terms of this Privacy Policy. If you do not consent to the collection, use and disclosure of your personal information in accordance with this Privacy Policy, do not use the Website or provide us with any personal information.
II. Information We Collect
a. Information You Provide
We collect certain personal information you provide to us (such as your name, address, telephone number or e-mail address) at the time you sign up to become a member. When you complete a transaction on our Website, we or our third party service providers may also collect your credit card information. Personal information is information that identifies or could reasonably be associated with you. You can choose not to provide us with such personal information although this may affect your ability to complete transactions, to receive communications from us or use our Website.
When you make purchases through the Website, we process your payments through a third-party payment processor. In these instances the third-party may collect certain financial information from you to process a payment on our behalf, including your name, email address, address and other billing information in which case the use and storage of your financial information is governed by the third-party’s terms, conditions and privacy policies.
b. Learner Information
When you register for one of our courses or take our exams, your instructors, accredited educators and our administration will have access to some of your personal information in order to communicate with you, facilitate your participation in the course or program, and to monitor and assess performance. Our instructors are independent contractors, and are contractually obligated to use your personal information only for purposes connected with their role in teaching with the CPSA.
We record your performance in our courses and exams, and you may access and review your results at any time. If applicable, your team manager may also have access to your learner data, including badges earned, designation status, designations completed, and examination progress. We may also share your performance information with your employer or other parties upon your request.
c. Automated Information Collection
We receive and store certain types of information when you interact with our Website and CPSA learning portals. This may include information such as the type of Internet browser or computer operating system you are using, unique device identifiers for advertising (such as Google Advertiser ID or IDFA), geographic position, and usage data such as how long you spend on a particular page or what parts of the page you interact with, or which partner offers you engage with.
We and our third party service providers use this information for operational and maintenance purposes, and to optimize our Website and to improve the services we provide. In addition, when you view the Website, we may store some information on your computer in the form of a "cookie" or similar file. Cookies are small pieces of data which are stored on your computer to allow your Internet browser to remember something about a website, and identifies you to us when you visit our Website. At your option, you may turn off our cookies using the applicable features contained in your Internet browser; however, doing so may prevent you from accessing all or part of the Website.
d. Email Subscription
Where applicable, we will seek your express consent to contact you, including by way of commercial electronic emails. This consent is sought by the CPSA and you can contact us at the email address or mailing address below. You may opt-out from such email communications at any time by clicking on the “unsubscribe” link in the footer of the email. Please be aware that, even if you have opted out of receiving marketing communications from us, we may still contact you for purposes such as providing member updates and facilitating your past or current course participation, or as may be required by law.
III. How We Use and Disclose Your Information
We may use the information we collect to process a transaction or respond to your inquiry, to help us better understand your needs or how we may improve the services that we offer you, to contact you, and otherwise in accordance with applicable law.
Your information may be shared with our agents, independent contractors or third-party service providers in connection with services that these individuals or entities perform for us. Our successors and assigns may collect and use your information for substantially similar purposes as described in this Privacy Policy. Except as set out in this Privacy Policy, we do not sell, trade, or otherwise transfer your personal information to outside parties. We may, however, disclose your personal information in the following limited circumstances:
- As necessary to our service providers that help us with our business operations, including instructors and accredited educators;
- Where applicable, we may share your learner data with your team manager, including badges earned, designation status, designations completed, and examination progress;
- Upon request, we may share your performance in our courses and exams with your employer or potential employer;
- If necessary to protect the safety or security of users of the Website, to detect and prevent fraud or abusive behaviour, or when otherwise required or permitted by law;
- In the event that we sell, transfer or otherwise dispose of the business to an affiliate, successor, assign or other third party entity; or
- With your consent.
Otherwise, we will not disclose your personal information to others without your consent.
IV. Security
We take our commitment to keep your data secure seriously and will take reasonable precautions to protect your personal information from access, loss, misuse or alteration. Agents, contractors or third party service providers of CPSA who have access to your personal information in connection with providing services to us are required to keep the information confidential and must use the information in accordance with this Privacy Policy. We keep your personal information only for as long as it is required and we destroy, delete or convert such information into an anonymous form when it is no longer required. Legal requirements, however, may require us to retain some or all of the personal information we hold for a period of time that is longer than that for which we might otherwise hold.
V. Children
We do not offer the Website to anyone under the age of majority in their jurisdiction of residence and do not knowingly collect personal information from children under 13. No one under age 13 may provide any information to or on the Website. We reserve the right to change this Privacy Policy, and any of our policies and procedures concerning our practices for managing personal information, at any time and without prior notice, subject to applicable law. Any changes that are made to this Privacy Policy will apply to both any personal information that we hold prior to the effective date of the amended Privacy Policy and any personal information that we collect on or after such effective date.
